The following are proposed measures by California’s legislature that will have a direct impact on your business. Please consider attending our 2020 Day at the Capitol to push back against these proposals.
Sugar-Sweetened Beverages

AB 764 (Bonta): Restricts the sale and promotion of sugar-sweetened beverages
AB 765 (Wicks): Bans placing sugar-sweetened beverages near point-of-sale
AB 766 (Chiu): [“BIG GULP BAN”] Limits sugar-sweetened beverages to 16 oz.
AB 138 (Bloom): Imposes a tax on sugar-sweetened beverages
SB 347 (Monning): Requires warning labels on sugar-sweetened beverages

Flavored Tobacco Ban

SB 38 (Hill): Prohibits a tobacco retailer from selling, offering for sale, or possessing with the intent to sell or offer for sale, a flavored tobacco product
SB 39 (Hill): Requires sellers, distributors, and nonsale distributors to deliver tobacco products only in conspicuously marked containers
AB 739 (McCarthy): Criminalizes selling flavored tobacco products

ICE Vehicle Ban

AB 40 (Ting): Requires sales of new motor vehicles and new light-duty trucks in the state to transition fully to zero-emission vehicles by 2040

Meal & Rest Break / PAGA

Recently, California Attorney General Xavier Becerra has appealed a federal action exempting fuel haulers from Meal and Rest Break laws. PAGA lawsuits affect all employers but companies employing drivers are especially at risk of these frivolous and harmful lawsuits. These issues have plagued common carriers and hampered drivers’ ability to quickly and safely deliver fuel.

Cargo Tank Vapor Recovery Certification

The California Air Resources Board is in the process of increasing the Cargo Tank Vapor Recovery program fee to cover the cost of staff, enforcement, and an IT system that would allow regulated parties to pay online securely. CFCA is working to ensure the fee accurately reflects the real costs of the program and to ensure that the proposed regulation will include a public process for any future fee increases.

Truck and Engine Mandates

The California Air Resources Board has put increasingly strict emissions rules on heavy duty trucks and has stated they want all trucks to be powered by electricity. CFCA and its partners have fought these harmful regulations every step of the way to ensure your business can continue to operate.
